The European Union Intellectual Property Office (EUIPO), based in Alicante, Spain, is the authority responsible for managing intellectual property, including trademark registrations, in the EU.
A registered European Union Trademark (EUTM) provides protection across all 27 EU member states, including Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, and Sweden. This also extends to certain territories like the Aland Islands (Finland), Guadeloupe, French Guiana, Martinique, Reunion (France), Azores and Madeira (Portugal), and Canary Islands, Ceuta, and Melilla (Spain).
The EU trademark registration process is relatively quick, with straightforward applications taking an average of 6 months from submission to approval.
Trademark applications in the EU can be submitted directly to the EUIPO or through the World Intellectual Property Organization (WIPO) via the Madrid System. We provide trademark filing services through the Madrid System.
In the EU, trademark rights are granted to the first to file, except in cases involving well-known trademarks.
For logo trademarks, the colors cannot be claimed, so the logo is protected in any color combination. If a trademark includes both text and graphic elements, the registration will only protect the combination as presented in the submitted logo. To protect the text or design independently, separate applications must be filed for the wordmark and the design.
The first step will be to gather information about the applicant and trademark, to analyze the viability of the trademark application in European Union. Result and recommendation within 24 hours.
Once your order is placed, we will create a draft of the application to be filed. We will file the application on your behalf, providing legal representation. Our team will closely monitor the process (which may take 4-6 months) and any related publications, keeping you informed via email of all progress and key deadlines until the registration is successfully completed.
Upon completion of the application process, the client will receive a registration certificate. After a successful registration, the trademark is added to the official register, and a certificate is issued by the European Office.
